- Version 1.0
- Effective: October 26, 2026
- Business clients (B2B)
1Purpose
These terms govern the use of the Gestion-Traiteur (GT) platform and its mobile apps by the businesses that subscribe to it (the “Client”). They apply to businesses only. By creating an account or signing an agreement, the Client accepts them.
2Definitions
- Platform: the GT software available online and its mobile apps (GT-App, GT-Photo, GT-Impression, GT-Livraison, GT-Inventaire).
- User: any person authorized by the Client to log in with their own access.
- Seat: a billed User access. Plans include a number of seats; additional seats are billed according to the price list.
- Module: a set of features included in a plan or offered as an option.
- Client Data: the information entered or imported into the Platform by the Client and its Users.
3Account and access
The Client designates its Users and assigns their permissions. Each User keeps their credentials confidential; two-factor authentication is recommended. The Client is responsible for actions taken with its Users’ access and notifies Gestion-Traiteur without delay of any unauthorized access.
4Term and renewal
The agreement takes effect on the subscription date and continues until terminated by either party. The Client may end it at any time by written notice. A monthly subscription ends one month after the notice is received; the fees for that last month remain payable. A yearly subscription is paid in advance for the current period and is non-refundable; it renews automatically for a further one-year period unless written notice of non-renewal is received at least one month before it expires.
5Pricing, billing and payment
Prices are those published on the Pricing page at the time of subscription. Monthly billing costs 20% more than yearly billing. Seats or modules added during the term are prorated. Payment is made by card or pre-authorized debit through Stripe.
- Canada: prices in Canadian dollars, before GST/HST and QST.
- France: prices in euros, excluding VAT. For VAT-registered businesses, VAT is reverse-charged to the customer.
- Prices may be adjusted at renewal with 60 days’ written notice.
- If payment is not made, access may be suspended 15 days after an unanswered notice.
6Professional services
Data migration, onboarding training and custom integrations are not included in the subscription. They are quoted separately, based on an estimate of the hours required.
7Support and availability
Support is included in every plan, Monday to Friday, 9 a.m. to 5 p.m. Eastern Time, with a very fast reply. Gestion-Traiteur aims for continuous availability of the Platform; service status is published at status.gestion-traiteur.com. Scheduled maintenance is announced in advance and carried out outside business hours whenever possible.
8Client Data
The Client remains the owner of its data. Gestion-Traiteur processes it only to provide the Platform, in accordance with its privacy policy. The Client can export its data at any time. When the agreement ends, data remains available for export for 30 days, then is securely deleted.
9Acceptable use
The Client agrees not to:
- use the Platform for illegal purposes or to send unsolicited messages;
- attempt to access other clients’ data or bypass security measures;
- copy, resell or decompile the Platform, except under a written agreement (reseller program).
10Intellectual property
The Platform, its apps, its documentation and the Gestion-Traiteur brand belong to Gestion-Traiteur. The subscription grants the Client a non-exclusive, non-transferable right of use for the term of the agreement. Suggestions made by the Client on the voting portal may be freely incorporated into the Platform.
11Third-party services
Some features rely on third-party services (Stripe, QuickBooks Online, Colossale POS, Google, Microsoft, etc.), which are subject to their own terms. Gestion-Traiteur is not responsible for their availability.
MEV-WEB: GT is not a sales recording system recognized by Revenu Québec. Sales are transmitted by Colossale POS, which is recognized by Revenu Québec. The Client remains responsible for its tax obligations.
12Liability
The Platform is provided with diligence and in a professional manner. Gestion-Traiteur’s total liability, for all causes combined, is limited to the amounts paid by the Client in the 12 months preceding the event giving rise to the claim. Gestion-Traiteur is not liable for indirect damages, including loss of profits or customers.
13Termination
Either party may terminate the agreement if the other party commits a serious breach that is not remedied within 30 days of written notice. Amounts owed for the current period remain payable.
14Changes to these terms
Gestion-Traiteur may change these terms. The Client is notified by email at least 30 days before they take effect. An unfavourable change allows the Client to terminate at no cost before that date.
15Governing law
These terms are governed by the laws of Québec and the federal laws of Canada applicable therein. Any dispute falls under the jurisdiction of the courts of the judicial district of Québec. A French version of these terms was made available to the Client before this English version; the parties have expressly agreed that these terms may be in English. In case of inconsistency, the French version prevails.
